SHIPPING AND DELIVERY
EUROBABYLON ships its goods throughout Italy exclusively via express courier. Shipments, unless otherwise agreed, will be carried out by carriers defined by EUROBABYLON. Insurance is included in shipping costs, even in the case of free shipping promotions. In the event of theft/loss EUROBABYLON undertakes to send a new product and, should it be unavailable and/or out of stock, it will offer a different product, but with equivalent or superior characteristics, with the customer having the right not to accept this new product and request a refund for the product itself. Upon delivery of the goods, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the packaging is intact, not damaged, wet or otherwise altered, including the closing materials. (adhesive tape or metal straps). Any damage or mismatch in the number of packages or indications must be immediately reported to the courier making the delivery. Once the courier document has been signed, the Customer will not be able to make any objections regarding the external characteristics of what was delivered. In this way, if a product is found to be broken it will be contestable to the courier. Without this wording the carrier does not accept complaints regarding the contents of the package. package. If, once the package has been opened, a product is physically damaged, the customer is required to notify EUROBABYLON within 2 days of receipt. The couriers used do not make preventive telephone calls nor handle shipment requests at particular times. Indicatively, without this entailing any constraints for EUROBABYLON and subject to the availability of the products on the market as well as any causes of force majeure, the goods will be delivered by EUROBABYLON to the courier within 24 hours from the first working day following the date of receipt of the order (in the case of payment by credit card or payment by cash on delivery to the courier).
RIGHT OF WITHDRAWAL
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number reference in the order form), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, without prejudice to what is indicated in the following point.
The right of withdrawal is however subject to the following conditions:
The products must not be used and/or worn, the packaging must be perfectly intact. For cell phones the conversation limit is 15 minutes.
the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, attached software, etc...);
the right does not apply to audiovisual products or sealed computer software (including those attached to hardware material), once opened;
the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc...); to limit damage to the original packaging, we recommend, when possible, to place it in a second box, bearing the RMA number (return authorization code); In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided;
in accordance with the law, the shipping costs relating to the return of the goods are borne by the customer;
the shipment, until receipt is certified in our warehouse, is under the complete responsibility of the customer;
in the event of damage to the goods during transport, EUROBABYLON will notify the customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain a refund of the amount value of the property (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the withdrawal request;
EUROBABYLON is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;
upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the package and/or the original packaging are damaged, EUROBABYLON will deduct a percentage from the refund due, in any case not exceeding 30% of the same, as a contribution to the restoration costs.
Without prejudice to any restoration costs for confirmed damage to the original packaging, EUROBABYLON will reimburse the customer the amount
GUARANTEES
All products sold by EUROBABYLON are covered by the manufacturer's conventional warranty and by the 24-month warranty (6 months for batteries) for defects of conformity, pursuant to Legislative Decree 24/02. The manufacturer's conventional warranty is provided according to the methods illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Assistance Centre, the defect is found not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as transport costs, if supported by EUROBABYLON. The 24-month warranty pursuant to Legislative Decree 24/02 applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number reference in the order form). In the event of a lack of conformity, EUROBABYLON will, at no cost to the Customer, restore the conformity of the product through repair/replacement or reduce the price, until the contract is terminated. If, following intervention by an Authorized Assistance Centre, the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as the transport costs if supported by EUROBABYLON. Replacements in the event of DOA (Dead On Arrival: product not functioning upon delivery) occur only if expressly provided for by the manufacturer. The timing of replacement or possible repair of the product depends exclusively on the manufacturer's policies. In the event that, for any reason, it is not able to return to its customer a product under warranty (restored or replaced), EUROBABYLON may proceed at its own discretion with the refund of the entire amount paid or with its replacement with a product of similar characteristics. equal or higher. No damages can be requested from EUROBABYLON for any delays in carrying out repairs or replacements. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer (at his expense) in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables , etc...); to limit damage to the original packaging, we recommend, when possible, placing it in a second box; In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided. It should be noted that, sometimes, flash memories may be supplied in the OEM version (without blister) without this modifying the terms and conditions of the warranty offered.
BILLING FOR COMPANIES
We remind our kind customers that all invoices issued against VAT numbers for the categories: smartphones, tablets, notebooks, microprocessors and consoles will be issued according to the legislation: Art. 17 Presidential Decree 633/72.
