1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

We remind our kind customers that all invoices issued against VAT numbers for the categories: smartphones, tablets, notebooks, microprocessors and consoles will be issued according to the legislation: Art. 17 Presidential Decree 633/72.
1.1 - The contract stipulated between EUROBABYLON and the Customer must be considered concluded with the acceptance, even if only partial, of the order by EUROBABYLON, which reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions transcribed below.

1.2 - With regard to the VAT treatment of the sums in question, it is specified that Eurobabylon issues an invoice without VAT as it is not considered within the scope of application of the community VAT legislation as established by Council Directive (EU) 2017/2455 of 5 December de 2017, for which Directive 2006/112/EC and Directive 2009/132/EC are amended in reference to certain obligations with respect to the value added tax for the provision of services and the distance selling of goods - Diary Official of the European Union of 29-12-2017.

1.3 - The payment of the import tax is provided for in art. 17 of Presidential Decree 633/1972 2nd paragraph which provides for self-invoicing for imports from non-EU countries. The self-invoice consists of a new copy of the invoice that the Italian transferee or client, with a VAT number, is required to issue to himself. This document must be dated and registered for annotation in the VAT sales register and in the VAT purchases register, thus cancelling


1.4 - The customer is required to provide all the requested data complete with tax code (for private individuals) or VAT number (for legal entities). If New eurobabylon italia srls does not have such data, the order will not be processed.

ATTENTION: the customer who, after placing the order, wishes to receive an invoice is kindly required to communicate his/her private tax code, or company data + Recipient Code issued by the Exchange System (SDI) to allow us to issue and send the tax invoice.
For VAT purposes, these indirect e-commerce operations are assimilated to mail order sales
the relevant provisions contained in the decree of the President of the Republic N.633/72 will apply.
Therefore, they will not be subject to the obligation to issue an invoice (unless requested by the customer at the time of purchase, as required by article 22 of the dP)
In fact, for the online seller there is an obligation to write down in a special register all the fees for sales made without requesting an invoice
(so-called compensation register provided for by article 24 of Presidential Decree 633 of 1972).
For the guarantee, a delivery note is issued as a guarantee document which is always valid for 2 years as required by law.

1.5 - Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by non-acceptance, even partial, of an order.



2. PURCHASE METHOD 🛒

2.1 - After payment, correct receipt of the order is confirmed by EUROBABYLON by means of a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will contain the Customer Order Number, to be used in any further communications, the Date and Time of execution of the order and the shipping times to be respected for delivery of the goods. The message presents all the data entered by the Customer who undertakes to verify its correctness and promptly communicate any corrections, according to the methods described in this document. In the event of non-acceptance of the order, EUROBABYLON undertakes to promptly notify the Customer, using the same methods.

2.2 - Taking into account the volume of daily transactions, EUROBABYLON does not guarantee the absolute availability of the products or services ordered. In the event of stocks running out, the company will contact the Customer by telephone as soon as possible to inform him and to propose modifying or canceling the order. In the event that we are unable to have telephone contact with the Customer, we will inform him via eBay messages.

2.3 - The Customer can only purchase the products present in the electronic catalog of the electronic-discounted store at the time of placing the order. It is understood that the image accompanying the descriptive sheet and the product may not be perfectly representative of their characteristics but may differ in terms of characteristics, colours, dimensions present in the figure and the accessories supplied, as they are sold with the accessories which include the producer. All information supporting the purchase is to be understood as simple generic information material, not referable to the real characteristics of a single product. Therefore, we invite the customer to send us a message before purchasing to receive information regarding the accessories present in the original packaging.

2.4 - EUROBABYLON reserves the right to change prices at any time, without notice.

2.5 - On certain products, subject to price promotions, EUROBABYLON reserves the right to accept orders by reducing the quantities, subject to communication and acceptance by the Customer, failing which the order will be considered cancelled.

2.6 - We would like to specify that in exceptional cases, very rarely, some products may be supplied with missing or broken seals, this is because the distributor carries out random checks on the goods.



3. PAYMENT METHODS 💳

3.1- The accepted payment method is immediate payment via Paypal, Amazon Pay, credit card and advance bank transfer. The order will be processed immediately after the payment confirmation email.


4. MESSAGE TO THE SELLER 💬

4.1 - For important communications, such as a different invoice heading, buyers must notify us via the "Message for seller" at the time of ordering.

4.2 - For questions about the availability of products on sale or for further information, the Customer must contact us via messages in which our operators will respond to all requests within 24/48 working hours.

4.3 - Change of address is not accepted if this is different from the address indicated on Paypal or Amazon Pay at the time of payment.


5. CANCELLATION AND REFUND METHOD 💸

5.1 - Cancellation is possible until the goods are shipped.

5.2 - In the event that the Customer wishes to cancel the order, we will proceed with the cancellation of the order by quickly sending an email to the address provided in the order, in which the Customer must confirm the cancellation.

5.3 - The refund will take place automatically, the Customer will receive a refund of the amount paid to the card used for the purchase within 24/48 working hours. Instead, those who used the bank or postal transfer as a payment method will be contacted to provide the data to be used to issue the refund via bank transfer.

5.4 -Under no circumstances can EUROBABYLON be held responsible for any damages, direct or indirect, caused by delay in the failure to release the committed amount by the banking system.



6. TELEPHONE CONTACT 📞👥

6.1 - The telephone number inserted in our advertisements is used only for situations in case of necessity or to manage post-sale situations quickly and professionally by our operators. For all other requests we invite buyers to write to us via messages.



7. SHIPPING METHODS 🚚

7.1 -. EUROBABYLON can accept orders with delivery in the territory of the Italian state and in exceptional cases Europe. Delivery times vary from 2 to 7 working days as reported in the advertisement under the heading "Estimated delivery" excluding Saturdays and Sundays. Shipping within Italy is always free but for islands or remote areas delivery times are 2 working days longer than standard times.

7.2 - Our goods are shipped via GLS, Bartolini, DHL or SDA courier.

7.3 - For each order placed, EUROBABYLON issues an invoice for the material shipped, delivering it directly to the order holder, pursuant to Article 14 of Presidential Decree 445/2000 and Legislative Decree 52/2004. For issuing the invoice, the information provided by the Customer at the time of the order is valid. No changes to the invoice will be possible after it has been issued.

7.4 - No responsibility can be attributed to EUROBABYLON in the event of a delay in processing the order or in delivering what was ordered.

7.5 - In the event that the customer provides, within the order, an incorrect delivery address (missing house number, wrong country, wrong postcode, etc.) and the courier is unable to complete the delivery for this reason, any shipping changes will be charged to the customer.

7.6- In some cases, even if the goods are delivered within the times indicated in the advertisement, the courier, being autonomous, manages his shipments in total freedom, taking more than 48 working hours to deliver the goods.

7.7 - We would like to specify that deliveries are NOT made to POST OFFICES and COURIERS.

7.8 – The goods cannot be refused as the correct procedure is that the customer must accept the goods, contact us, open the return procedure. In the event that the customer refuses the goods we will issue a partial refund without deducting the shipping costs.

7.9 - For shipments to disadvantaged locations (Venice islands, smaller islands, etc.) and any location indicated by the courier as a disadvantaged area, it is mandatory to pay a shipping supplement of €24.50 per order. Not being able to enter the additional request in the eBay check-out, a message will be sent to the customer with an integration request via Paypal.



8. GUARANTEE 🛡️

8.1 - The products marketed by the EUROBABYLON company benefit from the 2-year European manufacturer's warranty.

8.2 - The tax document/invoice which is a valid document to take advantage of the guarantees, will be delivered via email address.



9. RETURN METHOD 🔄

9.1 - The goods can be returned up to 14 days from the date of purchase. The customer can exercise his right of withdrawal up to 14 days from the date of receipt of the product and the refund takes place no later than 14 days as issued by the European Directive 2011/83/EU on consumer rights regarding withdrawal and refund

9.2 - If the package is delivered with characteristics different from those indicated in the point indicated above, the costs of restoration will be charged depending on the condition of the goods or the accessories supplied (from 10% to 100% of the amount of the goods). If the returned goods are found to be working, the customer will be charged for shipping costs of €15.37.

9.3 - If the package is returned sealed, i.e. it is returned with the box never opened, the refund is immediate. If this is not the case, i.e. the product is returned with the box open, the refund may take up to 14 working days.

9.4 - Upon delivery of the goods by the courier or authorized person, the Customer is required to check: - that the number of packages delivered corresponds to what is indicated in the order form and in the attached invoice. - that the packaging is intact, not damaged, or in any case not altered, even in the closing materials (adhesive tape or metal straps). Any damage or mismatch in the number of packages or indications must be immediately reported to the person making the delivery. Once the delivery document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what was delivered. Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported to EUROBABYLON within 3 days of delivery, according to the methods set out in this document.

9.5 - In the event that the Customer purchases by mistake and wants to return the goods due to an incorrect purchase, he must bear management costs of €15.37 per package and the number of packages must respect the number of packages sent initially. After receiving the requested documentation and payment of expenses, we will send the courier responsible for the collection within 3 to 4 days after payment.

9.6 - In the event that the Customer receives incorrect goods due to an error due to our warehouse, he must contact us immediately via messages by sending us photos of the incorrect goods received and subsequently the Customer must send us the goods to the address that we will provide via messages.

9.7 - In the event that the Customer receives defective or non-functioning goods, he can return the goods no later than 14 calendar days as provided for by the Customer Guarantee -. After this deadline we are not responsible for the condition of the goods and the Customer will have to take advantage of the product warranty at an authorized assistance center.

9.8 - For some products (for example Apple, Notebook and PC) we do not accept returns because once initialized with the first startup, the warranty is automatically activated, valid from the moment the product is put into operation.

9.9 - For some Monitor manufacturers the warranty is 0 pixels which covers the breakage of all pixels, however, for other Monitor manufacturers the warranty can be used if it has more than 5 broken pixels.

9.10 – For all cartridges and toners if they are opened and used
